    3. By posting a completed copy of the Dutch Mushrooms Order Form to Anticipate V.O.F., Kerkenbos 1097-E, 6546BB, Nijmegen, The Netherlands.
    4. When you place an Order for a Product in any of the ways described above (“Order”) you are offering to buy it for the price stated, subject to these Terms.
  2. When you place your Order online we will send you an email to confirm that we have received it. This email confirmation will be produced automatically so that you have confirmation of your Order details. The fact that you receive an automatic confirmation does not necessarily mean that we will be able to meet your Order. Once we have sent the confirmation email we will then check availability and contact you with a further email. If the Product is available and the details of the Order are correct, this email will be deemed an acceptance and will specify delivery details and confirm the price of the Products purchased. If the Product is not available we will also let you know by email.
  3. Dutch Mushrooms may cancel any sale and not supply products if it is reasonable to do so and may change or discontinue the availability of products at any time at its sole discretion. If an order is cancelled, any payment made for the products will be refunded in full. This does not affect your statutory rights.
  4. All new Orders are deemed separate and each is treated individually.
  5. Strictly ONLY over 18 years of age to purchase from https://www.DutchMushrooms.com/ – By making an account or buying products you agree to our terms and conditions and confirm you are 18 or over.
  6. Dutch Mushrooms sends its seeds and products with the restriction that they are not used for purposes that are against the law or against local applicable laws. Dutch Mushrooms has never intended anyone to encourage or incite to act against the law. We expressly point out that anyone who buys our seeds and products is responsible for his or her (future) actions. Dutch Mushrooms accepts no liability in this regard. All content and information on our website is informative in nature.
  7. All descriptions about products, services and actions on our site come from companies and books written in countries (like the Netherlands) where their existing laws and regulations do not prohibit the use of certain substances. This means that some descriptions describe a certain effect after consumption, but certainly don’t mean that products are intended or suitable for consumption. All texts and descriptions are provided for informational purposes only, as our products are intended for consumers, such as botanical students, naturalists and collectors of souvenirs from the Netherlands.
  8. By placing an order with Dutch Mushrooms you accept all responsibilities concerning the legal status of the products that will be sent to you. All products on our website are legal in the Netherlands. You accept the responsibility to keep yourself informed of the laws, import and customs regulations in your particular country before ordering and you certify that the import of the ordered products in your country is legal. If you have any doubt we recommend you consult your attorney.
  9. This website may not be accessed, displayed or otherwise be seen in countries where it possibly violates the law or customs regulations.
  10. Dutch Mushrooms does not claim or imply that its products are suitable to treat, cure or prevent any disease or condition. Dutch Mushrooms does not give specific medical advice.
  11. Do not use our products if you suffer from high blood pressure, cardiovascular disease, diabetes or any other health or mental problems. Do not use our products during pregnancy or breastfeeding. Do not use our products in combination with MAO inhibitors or any other medication. Driving and using heavy machinery should be avoided when using our products. Always check with a doctor and follow his advice. Keep our products out of reach of children.
  12. You accept full liability for any injuries, damages, penalties, loss of income or assets that result from the purchase, consumption, use and / or abuse of a product of Dutch Mushrooms. The company and its owners, agents and employees are not responsible for the actions of customers.
  13. Strictly ONLY over 18 years of age to purchase from.
  14. Our warranty does not extend to these items due to the nature of the products. For health and safety reasons, as well as hygiene, we cannot offer warranty on either. This is unless our staffs determine that the item received is the incorrect item or if there are any other extenuating circumstances.
  15. By placing an order with Dutch Mushrooms you accept all responsibilities concerning the legal status of the products that will be sent to you. Price

  1. The price for each product is shown on Dutch Mushrooms and includes VAT at 6% or 21% depending on the products
  2. We always try to make sure that the prices on Dutch Mushrooms are accurate but errors may occur. If we discover an error in pricing of the products in your order we will inform you as soon as possible using the contact details you supply us with. We will then give you the option of reconfirming your order at the correct price or cancelling it. (If we are unable to reach you we will treat the order as cancelled). If an order is cancelled, any payment made for the products will be refunded in full.
  3. You will be notified of the delivery costs automatically before you submit your credit card details, based on the delivery address you specify.
  4. Prices are quoted on Dutch Mushrooms in EURO
  5. Customers are responsible for Import Duty/Tax in their respective countries. Unfortunately we cannot advise you what these costs will be – please consult your local customs office for more information.

Payment

  1. You must pay for your Order before it is delivered. You can do so by credit card, debit card or by using Pay Pal.

Credit Card

  1. Orders may be processed online, or by telephone, using a credit card (VISA, MasterCard,) or debit card (Visa and MasterCard debit cards only). We aim to debit money from your account within one working day after receiving your order.
  2. To ensure that shopping online is secure, your credit/debit card details will be encrypted to minimise the possibility of someone being able to read them as they are sent over the Internet.
  3. Your credit card company may also do security checks to confirm it is you making the order.
  4. All order details and invoices will be sent to the credit card billing address and not the delivery address where the named recipient of the order differs.
  5. We also take Pay Pal.

Availability

  • We try to keep Dutch Mushrooms as up to date as possible but cannot guarantee that any particular product will always be available. If we can’t supply a product you will not be charged for it and we will refund or re-credit your account with the amount debited by us.
  • All offers are available while stocks last. If we are unable to supply a product you have ordered, we will notify you as soon as we can after receiving your order. If this happens, you may cancel your order and we will refund you the money you have paid for it.

Delivery

  • Dutch Mushrooms delivers to most countries worldwide.
  • You will be notified of the delivery costs automatically before you submit your credit card details.
  • Dutch Mushrooms aims to deliver products within 2-5 Working days in most circumstances, however, each product has a link on the product page stating the estimated delivery time for that product and you should refer to these for more details about delivery times.
  • Orders are despatched either by UPS, Asending or POST NL may require signature depending on the shipping method.
  • We will make every effort to deliver within the time stated on Dutch Mushrooms but we will not be liable for any loss caused to you by late delivery.
  • If the products are not delivered within the estimated delivery time which we quote, please contact us by telephone or email and we will try and ensure that you receive your order as quickly as possible, or if you wish you may cancel your order and we will refund the money you have paid. Please note that while items sent by international airmail usually arrive within 4-10 working days, some parcels may take longer to be delivered.
  • Please order from Dutch Mushrooms with enough lead-time to prevent any loss or disappointment resulting from the delivery time as we cannot be responsible for this.
  • This does not affect your statutory rights as a consumer.
  • Please also note we cannot guarantee non tracked international deliveries.
  • Dutch Mushrooms does not give you any right or interest in any copyright or intellectual property rights in any product nor the right to copy them.
  • The copyright in Dutch Mushrooms and the content of all the software, web site and pages relating to the Dutch Mushrooms web site is owned by, or licensed to Anticipate V.O.F., unless otherwise specified and may not be used, copied or altered without our expressed consent.
  • Copyright extends to the design, look and feel of Dutch Mushrooms, all photographs on it and its marketing materials.
  • You may use Dutch Mushrooms for private and personal non-commercial use only – i.e. to view, copy and print portions of Dutch Mushrooms for the sole purpose of placing orders. The materials on Dutch Mushrooms may not be used for any other purpose.
  • Dutch Mushrooms does not make any warranty or representation in respect of any other trade mark and the trademarks of the brands featured on Dutch Mushrooms

Marketing Communications

  • If you have ordered products from the Dutch Mushrooms web site before it is possible that we have this information already and it is being used to contact you about offers, events, items or related activities that you may find useful.
  • If you are an existing customer we will continue to keep you informed unless you tell us not to.
  • If you are a new customer we will give you the choice (for example once you have placed an order) whether or not you want us to contact you about future offers, events and new products or related activities that you may find useful. We will not bombard you with emails, but we’d like to keep you informed of the developments on Dutch Mushrooms
  • We do not sell, trade or rent your personal information to other companies.
  • Dutch Mushrooms will not send you any marketing emails or pass your information on to third parties unless you give us your consent, or unless we have it already.

Refunds

  • All sales are final. Orders can be refunded prior to fulfillment and shipping but once the order has been fulfilled and/or shipped, no refunds will be issued.

Faulty Products

We try to select and package the products as well as possible to ensure they arrive in good condition. However, if a product arrives damaged or with defects, or is not what you ordered, we will replace it free of charge or provide a full refund as appropriate, if you return the product to us unused at the postal address below within 30 days of receipt.

  • In these circumstances we will also pay you the cost of the return postage. Please obtain a proof of posting certificate from your Post Office to enable us to process the refund for your return postage costs.
  • You will only have to pay for the return postage of the Products.
  • For help with items later than 30 days after your initial purchase please email us for more information.
  • This does not affect your Statutory Rights.

Returning Faulty Products

  • Please contact us by email info@dutchmushrooms.com to inform us of your wish to return products.
  • We may allocate you with a returns code which should be included with the package to improve processing of your return.
  • We may also advise you how to send the item back to us. Occasionally items may have to be picked up by a courier service. Otherwise, please use a secure delivery method which requires a signature upon receipt and return to: Dutch Mushrooms Customer Returns, Kerkenbos 1097E, 6546 BB Nijmegen, The Netherlands.
  • You will be responsible for the returned products until they reach us.
  • Due to the bespoke nature of custom-made products we are unable to offer our usual 30 Day Money Back Guarantee on unwanted goods.
  • In the case of high value items in excess of € 2,000 the usual money back guarantee is limited to 7 days and you shall be responsible for the cost of return within 7 days of receipt.
  • This does not affect your statutory rights.
